Alberta Traffic Tickets - How often will the Crown dorp the points on a ticket?

May 11th, 2012

I am asked this all the time.  People seem to think that if they go in on their own and ask the Crown the points will get dropped.  This was true up until a couple of years ago.  Points are the government and the insurance industry way of flagging bad drivers, so dropping points was letting these drivers fall below the radar.  So in most cases, the points will not entirely go away.  However, in some busier Courts, like Calgary Traffic Court and Edmonton Traffic Court, they will consider alternative charges under appropriate circumstances which minimize or eliminate the points.  The only way you will be able to argue this with the Crown is if you have experience with the possible reduced offences as the Crown will not routinely give you this information.  For more information, or a free consultation, please call us at (403) 560-8550 or visit our website to send us an email.  Our website is http://AlbertaTrafficTickets.com.

Alberta Traffic Tickets - No More Automatic Set Asides!

May 6th, 2012

Overt the past few years, if you filed an Affidavit saying that you weren’t aware of a conviction (you lost the ticket) the Court would allow you to set aside the conviction and try again.  However, the Crown in now routinely objecting to these applications.  That means that you must be on top of your tickets as you may only get one chance.  I have a case now where the client (who lives in Ontario) has been told that he can’t get a job driving truck due to a conviction.  Now he has to try and convince the Court that he had a valid excuse for not fighting the ticket.  If you are faced with these types of situations, you need professional help and you need it right away.  Call us anytime at (403) 800-6627or email us at calgaryparalegal@gmail.com.  We can assist you in most Courts in Alberta.  Visit our website at http://AlbertaTrafficTickets.com for more information.

Alberta Traffic Ticket - New Impaired Law

December 3rd, 2011

Well, the new impaired driving law is expected to pass within the next few weeks.  At that time almost every Peace Officer (more that just cops) will be able to charge and convict drivers under the new law.  If you are eventually charged with impaired driving (blowing over .08) your license will be suspended until you go to Court to resolve your matter.  In many cased, if you have a valid defence, this could be more than one year.  If you lose the battle, you will then be suspended for another year.  There is no credit for the suspension you have already served!  There is one bright spot in the new laws.  You have the RIGHT to appeal your suspension to the Alberta Driver Control Board.  If they find that, on the balance of probabilities, that you may not have been over the legal limit, then they will have to return your license until the Court date.  A court agent and/or paralegal can assist you with this appeal process.  For more information, please call our office at (403) 560-8550.  You can also visit our website at http://AlbertaTrafficTickets.com

Alberta Traffic Ticket - Do All Tickets Have Demerits?

September 25th, 2011

I am asked this question all the time, I got a photo radar or distracted driving ticket and I want to know if I should fight it.  The reality is that these tickets carry no demerit points so the cost to fight the ticket is probably not worth the investment in using a service like ours.  However, having said that, sometimes for work related reasons it is necessary to fight these types of tickets.  I recieved a call from a client in Calgary yesterday where the company he works for charges back these tickets to the driver AND they keep track of the number for the insurance company.  This is part of their contract with the insurance company.  This person has a real reason to dispute the ticket (a red light camera offence).  Just so you know, we have discussed this specific offence with associates of ours in California (where they have had red light cameras for many years) and have been advised of serveral defences that are effective against these types of charges.  For more information, you can call us at (403) 560-8550 or email for a FREE consultation.  You can visit our website at http://AlbertaTrafficTickets.com for more information about traffic ticket defence in Calgary, Edmonton, or any other Alberta city.

Why can’t I fight my own traffic ticket

September 15th, 2011

We are asked this question all the time.  My answer may suprise you.  In some cases, you can fight the ticket yourself.  You must put the time and money question in perspective.  Most people will have to take a day off of work, prepare their statements, and then present their position to the Crown.  Just remember, the Crown does this hundreds of times per day.  Do you think that they have any incentive to give you the best deal?  They just don’t!  Any deal may not be the BEST deal.  If you can’t anaylze the disclosure, know the standards of proof, and have experience with what deals they make with others, you just do not have enough information to know if the deal being offered is good or bad.  I am a law student in California (which follows common law rules the same as Alberta) and I have over ten years of experience working within the Court system.  We just have the experience to make sure you are getting the BEST deal possible given the circumstances.  We always offer a free telphone or email consultation.  Feel free to call us at (403) 560-8550 or email me at office@albertatraffictickets.com.  Visit our website at anytime at http://AlbertaTrafficTickets.com.

Traffic tickets can have a drastic, negative affect on your future for the next three, five or ten years.  If you accumulate too many tickets, you can lose your license.  In today’s competative job market employers are more than willing to deny jobs that require driving vehicles if you have more than a couple of tickets.  Our experienced paralegals have many years of dealing with these matters in the Alberta Court system.  In most cases the impact can be reduced or eliminated using one or more of our strategies.  Remember, we offer a free telephone or email consultation before you hire our company.  At least spend a few minutes discussing your matter with us before paying.  You can email us at office@albertatraffictickets.com or call our company cell phone at (430) 560-7847.  We have offices in Calgary, Edmonton, Red Deer and Medicine Hat.
